{"id":6395,"date":"2017-03-02T00:00:00","date_gmt":"2017-03-02T00:00:00","guid":{"rendered":"http:\/\/aiyon.es\/noticias\/new-stevedore-service-regulation\/"},"modified":"2019-01-29T10:36:55","modified_gmt":"2019-01-29T10:36:55","slug":"new-stevedore-service-regulation","status":"publish","type":"post","link":"https:\/\/aiyon.es\/en\/new-stevedore-service-regulation\/","title":{"rendered":"New Stevedore Service regulation"},"content":{"rendered":"<p><img decoding=\"async\" class=\"alignleft wp-image-4371\" src=\"http:\/\/www.aiyon.es\/wp-content\/uploads\/2017\/03\/20160422_131227-1-300x225.jpg\" width=\"200\" height=\"150\" \/><span lang=\"EN-US\">The Official State Bulletin (BOE) dated February 25<sup>th<\/sup> 2017 has published the Royal Decree \u2013 law 4\/2017 of February 24<sup>th<\/sup> that modifies the regulation of workers that provide port cargo handling services and operations in order to comply with the judgment of the Court of Justice of the European Union of December 11<sup>th<\/sup> 2014, in the case C-576\/13 (infringement proceedings 2009\/4052). <a href=\"https:\/\/www.boe.es\/boe\/dias\/2017\/02\/25\/pdfs\/BOE-A-2017-1933.pdf\" target=\"_blank\" rel=\"noopener\">Except for part 4 of the First Transitory Provision, the aforementioned Royal Decree \u2013 law came into force on the day after its publication<\/a>.<\/span><br \/>\n<!--more--><\/p>\n<p><span lang=\"EN-US\"><span class=\"\" lang=\"EN-US\">The<\/span><span class=\"\" lang=\"EN-US\">\u00a0judgment of <\/span>the Court of Justice of the European Union of December 11<sup>th<\/sup> 2014 sanctioned Spain for considering that the legal regulation\u00a0for port handling services in Spanish ports contravened article 49 of the Treaty on the Functioning of the European Union. For this reason, the mentioned judgment demanded modification of the existing regulation \u00a0in order to allow free recruitment of permanent or temporary workers, who must have adequate professional training. In particular, the following two options are considered to be legally acceptable<\/span>:<\/p>\n<p>1.- <span lang=\"EN-US\">That the stevedoring companies themselves manage the employment offices, which should provide them with labour force, and organize the workforce training.<\/span><\/p>\n<p>2.- <span lang=\"EN-US\">The possibility of creating a pool of workers managed by private companies that operate as temporary work agencies. These agencies will provide the stevedoring companies with labour force.<\/span><\/p>\n<p><span lang=\"EN-US\">A time limit of three years since the entry into force of the RD- law 4\/2017 <span class=\"\" lang=\"EN-US\">has been established<\/span>\u00a0for its implementation to enable a smooth transition between the two systems and assure labour rights of the SAGEP workers, additionally including for this purpose financial support by the Port Administration.\u00a0 SAGEPs will maintain certain percentage of activity stipulated in the RD \u2013 law which will allow their financing during the period of transition. After this time limit of three years, the SAGEPs may carry on developing their activity as long as they comply with the requirements established for temporary employment agencies within a free competition framework. <\/span><\/p>\n<p><span lang=\"EN-US\">This decision by the European Court of Justice entails the need to carry out \u00a0legal amendments and therefore the need to modify or derogate several articles of the State Ports and the Merchant Marine Act (RDL n. 2\/2011 of September 5<sup>th<\/sup>), particularly, the sections related to the management of workers of stevedoring services and article 2.1 \u2013 h) of the Spanish Labour Act (RDL n. 2\/2015 of October 23<sup>rd<\/sup>).
